These general sale Terms & Conditions shall apply to all contracts entered into by Nit i bod, craft business for design, fashion and accessories, owned by Barbara Jugovac (hereafter “we” or “us”), registered at The Croatian Chamber of Trades and Crafts under registry number 97719170, whose headquarters is at Matije Divkovića 25 street, Zagreb, Croatia. By placing your order and making a purchase agreement through this website www.sharena-design.com (hereafter “this website”), you are accepting these general Terms & Conditions. If a consumer does not agree to these Terms & Conditions, they are kindly asked not to use this website and not to make any orders. Terms & Conditions are in accordance with the laws of the Republic of Croatia, particularly taking into account the principles and provisions of European Union directives. We retain the right to modify these general Terms & Conditions and other regulation without prior notice. Contracting through this website is considered to be a distance contract. The consumer, with the status of buyer, concludes a purchase agreement with Nit i bod, with the status of seller.
A user (hereafter “you”) is a person that uses this website, including any buyer or visitor. If the user has an account on this website, they must keep their user account information secret, and are completely responsible for any damage resulting from unauthorized use of their user account.
The purchase agreement is concluded at the moment when we confirm the buyer’s order. We can cancel the purchase agreement if the buyer does not pay the purchase price amount, and we are not obliged to deliver the product until the moment of the receipt of the purchase price amount.
The content of this website is available in Croatian and in English. The official language for the conclusion of the purchase agreement is Croatian language.
We introduce the main product features on this website through photographs, description and basic information.
All products presented are exclusively hand crafted by Barbara Jugovac, the owner of the craft business, they are unique and one of a kind.
All photographs represent the actual product but sometimes colours of the actual product may slightly vary due to different photographic lighting sources or your display colour settings.
We reserve the right to modify the information at the website, including the product price and special offers without prior notice. All prices, payment conditions and special offers are valid only at the time of order and payment.
The purchase is performed on this website by selecting available products that are chosen by the buyer, based on the product’s photographs, description and basic information, putting them into the shopping bag, and filling all the required data during checkout. The purchase can be made only with the buyer’s confirmation that they have read and understood the general Terms & Conditions, and that they are aware that this constitutes an order with obligation to pay.
The buyer will be informed by e-mail about order confirmation (the receipt of the electronic message that includes the buyer’s order) and about the package shipment.
When for whatever reason we are unable to deliver the product(s) you ordered, we shall inform you by e-mail about the circumstances as soon as possible. Fortunately, such situations are very rare, but however if they happen we’ll do our best to suggest you alternative product and solve situation to your satisfaction. Of course you can also cancel the order if no satisfactory solution has been found.
By clicking on "Add to Shopping Bag" you can add the selected product to the shopping bag. The product is neither reserved, ordered nor purchased by adding it to the shopping bag alone. You can continue to add products or review the bag content by clicking on the Shopping Bag icon and finish the product selection process by clicking on "Checkout".
This will take you to a page where you will enter your shipping details. Further click on the "Continue" button to select the payment method - online payment by credit / debit card through WSPay system for secure online payment or bank transfer.
In the case of online card payments, clicking on the "Continue" button will bring you to the part where you can once again check all entered information and where we inform you that the payment must be made within 1 hour for the order to be valid. By confirming that you agree to the general Terms & Conditions and clicking on the "Buy" button, you go to the secure pages of the WSPay system, where you enter information from the card and complete the purchase process. Upon successful payment by card you will receive an order confirmation to your e-mail address, together with the general Terms & Conditions confirming that the order has been received and is being processed.
If you have selected "Bank transfer" as payment method, by clicking on the "Continue" button you will also come to the section for checking all entered information and informing you that payment is through a transaction account (via internet banking or at a payment institution – bank or post office) must be completed within 1 day for the order to be valid. Confirmation that you agree to the Terms & Conditions and clicking on the "Buy" button will automatically send you a pro forma invoice with all the information necessary for payment to your specified e-mail. After payment to our bank account, please send us a confirmation that you have made the payment.
Please check all all your listed data in order confirmation one more time to avoid possible mistakes which could cause delivery problems.

Payment
All prices on the website are displayed in Croatian currency Euro (EUR) by default. Since our craft business is out of the VAT system, there is no VAT and the buyer doesn’t pay VAT.
If you are in possession of a valid discount code, you can enter the code in the provided box on the order checkout form. The discount applies to the product(s) price and not to the shipping costs.
The shipping costs are paid in full by the buyer, except when otherwise indicated.
You can estimate exact shipping costs of wanted items even before entering all data necessary to make complete purchase by going to shopping bag overview and selecting country destination.
We deliver worldwide, but please bear in mind if your delivery address is outside the EU, you may have to pay import fees and tax on delivery. Import fees vary widely across the world, so please refer to your local customs office for further information. These taxes and duties are not included in the purchase price and are the responsibility of the buyer.
The users can change the currency in which prices are displayed, according to their preferences or local currency. Except in Euros (EUR) prices can also be displayed in US Dollars or British Pounds (USD, GBP). These prices are calculated according to the current exchange rate of the Croatian National Bank.
However, all payments will be effected in Croatian currency Euro (EUR). The amount your credit card account will be charged for is obtained through the conversion of the price in other currencies into Euros (EUR) according to the current exchange rate of the Croatian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of your credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated on our website.
On every payment preauthorization is done automatically at first. This means funds on the card are reserved, and payment is completed only once we confirm the transaction after the final verification of the availability of the ordered product(s).
When for some reason we are unable to deliver the product(s) ordered, we shall inform the buyer about the circumstances as soon as possible. The buyer can cancel the order or choose alternative product(s). Since every card payment on this website is preauthorised, in the case of order cancelation for that reason the credit/debit card of the buyer will not be charged at all (you don’t have to wait for refund).
We use WSPay advanced system for high security card payment through the Internet for all online payments.
WSPay is a secure system for real time credit and debit card payments, and other payment methods.
WSPay ensures the buyer and the seller with the secure card data entry and transfer, which is also confirmed by PCI DSS certificate. The confidentiality of your data is protected and ensured by the Secure Socket Layer (SSL) certificate using 256-bit encryption and the TLS 1.2 cryptographic protocol as the highest security levels for data entry and transfer. SSL encryption is a data coding procedure preventing unauthorized access during data transfer. This ensures safe information transfer and prevents unauthorized access to data during communication between the user’s computer and the WSPay service and vice versa.
At checkout the buyer is obliged to pay the product(s) they want to buy including shipping costs using one of the following card payment services: Visa Electron, American Express, MasterCard, Maestro, Visa, Diners Club International, Discover or DinaCard, or by making a payment to our bank transaction account if this payment method has been chosen.
We shall bear all costs of authorizing the credit/debit card of the buyer. The buyer is responsible for the correctness of the data provided.
WSPay ensures complete privacy of your credit/debit card data from the moment you type them into the WSPay payment form. Data required for billing is forwarded encrypted from your web browser to the bank that issued your payment card. Our store never comes into contact with your sensitive payment card data. Similarly, WSPay operators cannot access your complete cardholder data. An isolated system core independently transmits and manages sensitive data while at the same time keeping it completely safe. WSPay system works continually on the increase security and confirmation of that, which confirms certificate of compliance with PCI DSS standards.
Delivery
The purchase agreement is concluded at the moment we confirm your order after the final verification of the availability of the ordered item(s).
Please allow us up to 2 business days (Saturdays, Sundays, and Croatian national holidays excluded) after the receipt of payment of the full order price amount to hand all ordered item(s) to the delivery service.
All products are delivered in packages with the tracking number via Croatian Post delivery service. Tracking number or tracking code is a unique number assigned to each package, which allows you to monitor the movement of the package between the countries or even inside one country from the moment of receipt right until delivery.
We shall send you an e-mail with the confirmation together with the tracking number and the link to the website where the package can be tracked as soon as the package is handed to the delivery service.
You can track your package with the given tracking number on the following page of the Croatian Post website.
It usually takes up to one week for packages to be delivered in Croatia, up to two weeks inside the EU, and up to 4 weeks for the rest of the world. Please note, however, that these are only estimates for delivery times. If there is a storm, an accident or some other unfortunate problem then your delivery may be delayed, but such problems are infrequent and rarely delay our deliveries.
Please take care of making your order on time, especially in December before holiday rush when delivery time is usually increased, to receive your item(s) as planned.
Unfortunately, we are not able to influence the speed of delivery and possible complications related to the delivery caused by the delivery service.
If you don’t receive your package within the above mentioned estimated delivery time please contact us, we’ll do our best to find out what happened. However, if for some reason you don’t receive your package within reasonable time after this, we shall consider it lost and offer you full refund for your order or send you a replacement product (as you agree) free of charge.
We check every item before shipping very carefuly and pack it in a sturdy durable package to avoid possible damages during delivery service manipulation. However, the buyer is required to verify the delivered package at the time of package delivery. It is necessary to check if there are any obvious damages to the package outside in front of the delivery person in order to avoid subsequent claims about items damaged during the shipping.
In case the package has outside damage, the buyer is required to immediately notify the delivery person (file a complaint), and refuse to accept the delivered package. The buyer must also inform us immediately about the problem with the package damage to our e-mail hello@sharena-design.com.
If the buyer, for any reason, does not take over the shipment and it therefore returns to us, we shall repeat the delivery only if the buyer pays the cost of repeated delivery.
Returns
Customer satisfaction is our number one priority and we want all of our customers to be satisfied after receiving our hand crafted high quality products.
Please note that every hand made product may have some small imperfections because it’s not a serial machine product, but the work of an inspired artist who makes every product unique, and crafts them by hand what gives them unique charm.
However, if you are not satisfied with an item that you have purchased or you have just changed your mind, it’s not a problem - all purchases may be returned within 14 days after receiving them. This rule applies to all non-personalised and non-custom made products. Unfortunately, all personalised and custom made products are exempt from being returned - items made to order or clearly personalised items can not be returned or replaced. Before returning any product you have to notify us by sending us an e-mail to hello@sharena-design.com with a declaration stating that you are cancelling your contract of purchase.
The items have to be sent back to us immediately and no later than fourteen days after the date on which you have notified us of the cancellation of the purchase contract. Please ship returns to: Nit i bod, vl. Barbara Jugovac, Matije Divkovića 25, 10090 Zagreb, Croatia.
Please ensure that the item is in new condition (unworn and undamaged). All returned items must include original packaging, including all tags. Once we received the item(s) back, the refunded amount for returned item(s) (shipping costs, taxes and customs duties are excluded from refund) will be onto your credit card or to a your transaction account if you paid for the product in this way after the invoice was received, within 7 business days. All return shipping charges are covered by the customer. You’ll receive a confirmation e-mail when a refund has been done.
You can also contact us concerning any issues so that we may address them to your satisfaction. If an error has been made, we would appreciate an opportunity to make it right. If you send us an e-mail, please include as many details as possible including your order number as well as a picture if there is something wrong with one of the products. Your claim should be sent to us as soon as possible, we are sure we shall find solution for a problem to your satisfaction.

Complaints
The consumer can send complaints by mail to Nit i bod, vl. Barbara Jugovac, Matije Divkovića 25, 10090 Zagreb, Croatia or by e-mail to hello@sharena-design.com. In order to make it possible for us to respond to the written complaint which was not sent by e-mail, the consumers are kindly asked to state correct information about their name and surname, and the address where the reply is to be delivered.
We will respond to any complaint that is received within a term of 14 days after receipt.
Consumer disputes can also be solved through ODR platform of the European Commission.
Nit i bod acts as the controller of personal data and collects it for sales contract fulfilment, product delivery, sales documentation, technical support and credit/debit card payment authorisation for which legal basis is laid down in Article 6 of the EU General Data Protection Regulation. Furthermore, personal data is processed in order to store orders made by the buyers, to identify specific users and to analyse business activity for which the basis is laid down in Article 6 of the EU General Data Protection Regulation, since data processing is necessary for the need to legitimately improve business activity and adapt according to the market needs. In special cases, if you have given us your permission, your contact data can be used for direct marketing for which the legal basis is laid down in Article 6 of the EU General Data Protection Regulation which states that the data subject has given consent to the processing of his or her personal data for one or more specific purposes.
Which Personal Data do we process and how do we use it
Login information: e-mail address, password We use this information to create an account for you and give you access to your account. We need these data to perform our contract with you, i.e. to make an account for you and give you access to it.
Order information: name, delivery address, postal code, city, country, e-mail address, phone number and former order information We use this information to correctly ship and address your orders, contact you with any updates about your order, give you an overview of the orders you placed on this website before, i.e. we need these data to perform our contract with you, to process and deliver your orders.
Payment information: billing address and payment details We use this information to correctly process the payment of your order. We need these data to perform our contract with you, i.e. to process your payment.
Newsletters: e-mail address, sex, date of birth We use this information to send you our newsletter, so you will be fully informed of special offers and other relevant news. We ask for your consent to process these data. You can always withdraw this consent and unsubscribe from our newsletter.
We collect and store certain other information automatically whenever you interact with this website. For example, we collect your IP address, browser information and reference site domain name every time you visit this website. We also collect information regarding customer traffic patterns and site usage. This information is used to analyse and improve this website and to provide our customers with a fulfilling shopping experience. We shall not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide products or services you’ve requested, when we have your permission - legal persons that take part in sales contract fulfilment, for example delivery service, accounting agency, IT support and similar with whom we determine the scope and the means of personal data protection through contractual agreements. We shall ensure that the personal user data is kept on a safe location (which includes a reasonable administrative, technical and physical protection in order to prevent unauthorised use, access, disclosure, copying or modification of personal data), access to which will be granted only to our authorised personnel.
We do not record or store users transaction data needed for card payment.
We shall protect personal data to the extent laid down in specific legal regulations (data on financial transactions is stored for 11 years, as laid down by the Croatian Accounting Act) or until the right to use the data is repealed as per the data subjects wish if it does not interfere with the legal regulations.
